The dispute between John Textor and other shareholders of Eagle Football Holding has taken new chapters — the removal of the American businessman from the command of the SAF of Botafogo de Futebol e Regatas, the appointment of former president Durcesio Mello as interim director of the club- company, and a counterattack executed through a new judicial action. The story needs to be divided into nuclei, to facilitate understanding. In one of them, the discussion between Eagle Football Holdings shareholders is taking place in the Arbitral Tribunal of the Getúlio Vargas Foundation (FGV). It is in this sphere that Textor was removed from the SAF. The arbitration is an independent body, which does not belong to the Judiciary, but its sentence has judicial power. It is composed of arbitrators of trust of the parties and can be called upon to resolve patrimonial disputes, as is the case currently. On Thursday (23), the arbitrators concluded that recent measures taken by Textor “have the potential to cause irreparable damage to shareholders and the entire Botafogo fan community”. Thus, his removal from the operation was determined. Already on Friday morning, the SAF stated in a statement that the arbitration decision “substitutes, exceptionally and without due deliberation, the will of the shareholders”. According to the club- company, there was no specific request from any of the parties for the removal. Durcesio was then appointed as interim director. Durcesio was president of Botafogo de Futebol e Regatas, the association, during the transition of football to SAF. While he was in power, he gave political support for Textor to manage the football in the way he intended. The counterattack While the discussion between Eagle shareholders is taking place in the Arbitral Tribunal, Textor returned to common law. He has been manifesting himself through the SAF and has the support of the Basílio Advogados, Fux Advogados and Salomão Advogados law firms. The Sport Insider obtained a copy of the previous precautionary writ, filed by the SAF on April 21, as a preparatory step for the judicial recovery. It was addressed to the 2nd Commercial Court of the State of Rio de Janeiro. One of the main arguments presented is that, despite the financial crisis instaurated in Botafogo, it was not generated by internal administrative problems, but by the collapse of the “single box” system in force in Eagle. The SAF claims to have transferred 146 million euros (approximately R$ 1 billion) between 2024 and 2025 to help Lyon, France, which was facing severe punishments from the DNCG, the French league's accounting watchdog. Botafogo, Lyon, Crystal Palace, England, and Molenbeek, Belgium, formed the Eagle network. Textor was removed from the administration of Lyon when the rupture with Eagle shareholders and creditors became evident. Subsequently, Eagle had the company that manages the football clubs placed by the British Justice in a process of judicial administration, a kind of intervention that precedes insolvency. The intervention took away the decision-making powers of Textor, who remained in the business “only” as the majority shareholder. Now, the firm appointed to take care of the intervention, called Cork Gully, has put Eagle's assets up for sale on the market. Eagle notified SAF of Botafogo on April 17, according to the petition written by the club- company's lawyers, to disauthorize any request for judicial recovery. The holding reaffirmed in the Extraordinary General Assembly of April 20 that it will not make any contributions to the club.
